Certain services may be provided by appropriately qualified subcontractors or specialist service providers.

LA Homes reserves the right to decline work that falls outside our capabilities, available resources, professional qualifications or operational requirements.

4. QUOTATIONS AND ESTIMATES

4.1 Requesting a Quotation

Customers may request quotations through our website, telephone, email or other approved communication channels.

We may request information about the property, proposed work, location, access arrangements, measurements, photographs or other relevant details.

4.2 Estimates

An estimate represents an approximate indication of the anticipated cost of the proposed work.

Estimates are not fixed-price guarantees unless expressly confirmed as such in writing.

The final price may vary where additional work, unforeseen conditions, specification changes or other agreed adjustments arise.

4.3 Fixed-Price Quotations

Where LA Homes provides a fixed-price quotation, the agreed price applies to the specified scope of work, subject to any clearly identified assumptions, exclusions and agreed variations.

Additional services or changes requested by the customer may result in further charges.

4.4 Quotation Validity

Unless otherwise stated, quotations will remain valid for 30 calendar days from the date of issue.

We may issue an updated quotation after that period.

4.5 Acceptance

A quotation is accepted when the customer confirms acceptance through an agreed communication method and LA Homes confirms the booking or contract.

A request for a quotation does not itself create an obligation for LA Homes to undertake the work.

5. BOOKINGS AND APPOINTMENTS

Customers may book services through our website or by contacting LA Homes directly.

Bookings are subject to availability, service requirements and confirmation.

Customers must provide accurate information about the property and the requested work.

We may contact customers to confirm appointment details, assess requirements or arrange a preliminary inspection.

Where an appointment needs to be rescheduled, we will endeavour to provide reasonable notice.

Appointment times may be affected by traffic, emergencies, access difficulties, adverse weather or circumstances outside our reasonable control.

Any estimated arrival time will be communicated as accurately as reasonably possible.

6. SITE SURVEYS AND PROPERTY INSPECTIONS

Some projects require an initial property inspection or site survey before a final quotation can be provided.

During the inspection, we may assess:

  • Property condition

  • Access arrangements

  • Existing installations

  • Structural considerations

  • Required materials

  • Health and safety risks

  • Project complexity

  • Potential technical constraints

Where an inspection fee applies, this will be communicated before the appointment is confirmed.

An initial survey does not necessarily include specialist structural investigations, asbestos surveys, invasive inspections or statutory certification unless specifically agreed.

Additional investigations may be recommended where necessary.

7. PRICING AND PAYMENT TERMS

7.1 Service Charges

All prices will be communicated through the relevant quotation, invoice, booking confirmation or written agreement.

We will identify whether VAT is included or payable in addition, where applicable.

7.2 Deposits

Certain services may require an advance deposit to secure a booking, purchase materials or reserve project resources.

The amount, purpose and payment date of any deposit will be stated before the customer commits to the service.

Deposits will be handled in accordance with applicable consumer law and the agreed cancellation terms.

7.3 Stage Payments

Larger construction projects may require payments at agreed milestones.

A payment schedule may include:

  • Initial deposit

  • Project commencement payment

  • Progress payments

  • Completion payment

  • Final payment following agreed handover arrangements

The payment schedule will be established in writing before work begins.

7.4 Final Payment

Unless otherwise agreed, the outstanding balance becomes payable when the contracted work has been completed in accordance with the agreement.

Any applicable retention, snagging or certification arrangements will be governed by the relevant contract.

7.5 Payment Methods

LA Homes may accept payment through approved methods, including bank transfer, debit card, credit card or other payment systems made available to customers.

Accepted payment methods will be confirmed during booking or invoicing.

7.6 Late Payments

Customers must make payments by the agreed due dates.

Where a payment is overdue, LA Homes may issue reminders and seek to resolve the matter.

For business customers, applicable statutory interest and recovery rights may arise under the Late Payment of Commercial Debts (Interest) Act 1998.

For consumer customers, any late-payment charges must be reasonable, transparent and consistent with applicable consumer protection law.

7.7 Suspension for Non-Payment

Where a customer fails to make an agreed payment, LA Homes may be entitled to suspend further services, subject to the terms of the contract and applicable law.

We will provide any notice required by law or the relevant contract before exercising a right of suspension.

8. PROJECT MANAGEMENT SERVICES

LA Homes may provide construction project management services for residential and commercial developments.

These services may include:

  • Project planning

  • Budget preparation and monitoring

  • Construction scheduling

  • Contractor coordination

  • Procurement support

  • Progress monitoring

  • Site inspections

  • Risk management

  • Quality monitoring

  • Contract administration

  • Stakeholder communication

  • Project completion and handover

The extent of our responsibilities will be defined in the relevant project management agreement.

Unless expressly agreed otherwise, the appointment of LA Homes as project manager does not automatically make LA Homes the principal contractor, principal designer, architect, structural engineer or other statutory dutyholder.

The allocation of responsibilities under the Construction (Design and Management) Regulations 2015 will be confirmed where applicable.

Project management services do not constitute a guarantee that every project will be completed by a particular date or within a particular budget.

LA Homes will exercise reasonable care and skill in performing its agreed responsibilities.

9. CONSTRUCTION AND RENOVATION WORKS

Construction and renovation projects may involve unforeseen conditions that are not reasonably identifiable before work begins.

These may include:

  • Hidden structural defects

  • Defective electrical installations

  • Plumbing deterioration

  • Damp or water damage

  • Asbestos-containing materials

  • Underground obstructions

  • Inadequate foundations

  • Previously concealed building defects

  • Unexpected utility services

Where unforeseen conditions are discovered, LA Homes will notify the customer as soon as reasonably practicable.

Additional work will be explained and priced before proceeding, except where immediate action is reasonably necessary to address an emergency or safety risk and is permitted by law.

Any resulting changes to project cost or duration will be addressed under the agreed variation procedure.

10. CHANGES TO THE SCOPE OF WORK

Customers may request changes to the original scope of work.

These changes may include additional services, alternative materials, revised designs or changes to project specifications.

Where a variation affects the price, programme or other contractual obligations, LA Homes will communicate the proposed adjustment.

Variations should be agreed in writing before the additional work is undertaken.

LA Homes is not obliged to perform additional work that has not been agreed.

11. CUSTOMER RESPONSIBILITIES

Customers are responsible for providing reasonable cooperation throughout the delivery of services.

This includes:

  • Providing accurate property and project information

  • Ensuring appropriate access to the premises

  • Obtaining permissions for work where this is their contractual responsibility

  • Disclosing known hazards and relevant defects

  • Providing access to electricity and water where reasonably required

  • Removing or protecting valuable and fragile items where appropriate

  • Ensuring children and pets are kept away from hazardous work areas

  • Making agreed payments on time

  • Communicating changes or concerns promptly

Customers must not interfere with construction equipment, electrical installations, gas systems or other potentially hazardous works.

Failure to fulfil these responsibilities may result in reasonable delays or additional costs, where permitted by the contract and applicable law.

12. PROPERTY ACCESS

Customers must ensure that LA Homes and authorised personnel can access the property at agreed times.

Access arrangements may include keys, security codes, parking permissions or attendance by an authorised representative.

Where access cannot be obtained, an appointment may need to be rescheduled.

Any reasonable charges arising from failed access will be disclosed in advance where practicable and applied only where contractually and legally permitted.

LA Homes will take reasonable care when accessing and working within customer properties.

13. MATERIALS AND EQUIPMENT

LA Homes aims to use materials suitable for the agreed project specification.

Material selection may depend on availability, customer preferences, technical requirements and budget.

Where a specified product becomes unavailable, we will discuss a suitable alternative with the customer before making a material substitution.

Materials supplied by customers must be appropriate for their intended use.

LA Homes may decline to install materials that are unsafe, unsuitable, defective or incompatible with relevant requirements.

Responsibility for defective customer-supplied materials will be assessed in accordance with applicable law and the circumstances of the work.

14. SUBCONTRACTORS AND SPECIALIST TRADES

LA Homes may engage subcontractors or specialist tradespeople to deliver certain services.

These may include electricians, plumbers, gas engineers, carpenters, roofers, decorators and other construction professionals.

Where legally required, work will be undertaken by individuals or businesses holding the appropriate registration, qualifications or authorisations.

Gas work requiring registration must be carried out by a Gas Safe registered engineer.

Electrical work must comply with applicable safety and building regulations requirements.

The use of subcontractors does not remove any contractual responsibility that LA Homes owes to customers where LA Homes is the contracting service provider.

15. HEALTH AND SAFETY

LA Homes is committed to maintaining appropriate health and safety standards.

Work will be planned and undertaken with regard to applicable legislation, including, where relevant:

  • Health and Safety at Work etc. Act 1974

  • Construction (Design and Management) Regulations 2015

  • Electricity at Work Regulations 1989

  • Gas Safety (Installation and Use) Regulations 1998

  • Control of Asbestos Regulations 2012

Customers must disclose any known hazards that could affect the safety of workers, occupants or visitors.

LA Homes may pause work where an immediate or significant safety concern is identified.

Work will resume when appropriate safety arrangements have been established.

16. PLANNING PERMISSION AND BUILDING REGULATIONS

Certain construction works may require planning permission, building regulations approval, party wall procedures or other statutory consent.

Responsibility for obtaining these approvals will be established in the relevant agreement.

Unless expressly included in our services, LA Homes does not automatically undertake responsibility for securing planning permission or other third-party approvals.

Customers must not assume that a quotation includes architectural drawings, structural calculations, planning applications, building control fees or certification unless specifically stated.

Where LA Homes undertakes responsibility for coordinating approvals, the scope and associated fees will be confirmed in writing.

17. PROJECT TIMESCALES AND DELAYS

We will endeavour to complete services within the agreed or reasonably estimated timeframe.

However, construction schedules may be affected by:

  • Adverse weather

  • Material shortages

  • Supplier delays

  • Unforeseen property conditions

  • Customer-requested variations

  • Delayed approvals

  • Restricted site access

  • Utility interruptions

  • Events outside our reasonable control

LA Homes will communicate significant delays and provide updated completion estimates where appropriate.

Nothing in this section excludes liability for delays caused by a failure to exercise reasonable care and skill or other breach of contract.

Where a specific completion date is contractually binding, the relevant agreement will govern any entitlement to an extension of time.

18. WORKMANSHIP AND QUALITY STANDARDS

LA Homes aims to deliver professional workmanship that meets the agreed specification and applicable legal requirements.

Services provided to consumers will be performed with reasonable care and skill, as required by the Consumer Rights Act 2015.

Where relevant, materials and goods supplied as part of a contract must meet applicable statutory standards.

Customers should notify LA Homes promptly if they identify concerns about completed work.

We will assess reported defects and take appropriate action where we are responsible.

Any contractual workmanship guarantee will be described separately and will not replace or reduce statutory consumer rights.

19. DEFECTS AND REMEDIAL WORKS

If a customer believes that work is defective or incomplete, they should contact LA Homes with details of the issue.

Where practical, customers should provide photographs and relevant documentation.

LA Homes will review the complaint and, where appropriate, arrange an inspection.

If a defect results from our failure to meet contractual or statutory obligations, we will provide an appropriate remedy in accordance with applicable law.

Remedies may include repeat performance, repair, replacement, price reduction or other relief where legally required.

We are not automatically responsible for defects caused solely by unrelated third-party work, customer misuse or normal wear and tear.

However, such exclusions will not apply where LA Homes is legally responsible for the problem.

20. CANCELLATIONS AND RESCHEDULING

20.1 Customer Cancellations

Customers wishing to cancel a booking should contact LA Homes as soon as possible.

Cancellation rights and any applicable charges will depend on the type of service, contractual arrangements and relevant consumer protection legislation.

20.2 Rescheduling

Customers may request to reschedule appointments.

We will endeavour to accommodate reasonable requests, subject to availability.

20.3 Cancellation Charges

Where legally permitted, LA Homes may recover reasonable losses or costs resulting from cancellation.

Such charges must be proportionate and must not amount to an unfair contractual penalty.

20.4 Cancellation by LA Homes

We may cancel or reschedule services where circumstances prevent safe or lawful performance.

Examples include significant safety concerns, unavailable specialist resources or circumstances outside our reasonable control.

Where LA Homes cancels a service, the customer's entitlement to a refund or other remedy will be determined by the agreement and applicable law.

21. CONSUMER COOLING-OFF RIGHTS

Customers entering into certain distance or off-premises contracts may have a statutory right to cancel within 14 days.

These rights depend on the nature of the contract and any applicable exceptions under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Where the statutory cancellation right applies, LA Homes will provide the required pre-contract information and cancellation instructions.

If a customer expressly requests that services begin during the cancellation period, the customer may be required to pay a proportionate amount for services already supplied if the legal requirements for doing so have been satisfied.

In certain circumstances, the cancellation right may be lost once a service has been fully performed, provided the relevant statutory conditions have been met.

Some contracts, including certain urgent repair or maintenance services and specified categories of goods, may be subject to exceptions.

Nothing in these Terms and Conditions limits a statutory cancellation right.

22. REFUNDS

Refund requests will be assessed according to the relevant agreement and applicable law.

Refunds may be appropriate where:

  • A service has been cancelled within an applicable statutory cooling-off period

  • LA Homes cannot provide the agreed service

  • A payment has been made incorrectly

  • A customer is entitled to a remedy for defective or non-conforming services

  • A refund is otherwise required by law or agreed by LA Homes

Where a refund is due, it will be processed within the applicable statutory timeframe.

Refunds will ordinarily be returned using the original payment method unless otherwise agreed.

For further information, customers should refer to our Refund Policy.

23. SUBSCRIPTION SERVICES AND PAYMENT PLANS

LA Homes may offer monthly or annual subscription services for specified property maintenance or related services.

Subscription arrangements will be governed by the relevant subscription agreement and our Payment Plan and Subscription Policy.

Depending on the plan selected, subscriptions may include recurring monthly or annual payments.

Before entering into a subscription, customers will be informed of:

  • The subscription price

  • The billing frequency

  • The services included

  • Any exclusions or usage limitations

  • Renewal arrangements

  • Cancellation procedures

  • Applicable minimum commitment periods

  • Relevant statutory cancellation rights

Where automatic renewal applies, it will be clearly disclosed before the customer subscribes.

LA Homes will comply with applicable consumer protection requirements relating to subscription contracts, recurring payments, renewal notices and cancellation rights.

If there is a conflict between these general Terms and Conditions and the specific subscription agreement, the subscription agreement will govern the relevant service, subject to applicable law.

24. EMERGENCY SERVICES

LA Homes may provide emergency property repair services where available.

Emergency services may include urgent plumbing, electrical or other property maintenance work.

Emergency availability is not guaranteed unless expressly confirmed.

Call-out charges, emergency rates and any additional fees will be communicated before work begins wherever reasonably practicable.

Emergency repairs may initially be limited to making the property or installation safe.

Further permanent repairs may require a separate quotation or appointment.

25. CUSTOMER-SUPPLIED DESIGNS AND INSTRUCTIONS

Customers may provide drawings, specifications, designs or instructions for proposed work.

Where LA Homes is not responsible for preparing or verifying these documents, responsibility for their adequacy will be determined by the relevant contract and applicable law.

We may raise concerns where supplied information appears incomplete, unsafe or unsuitable.

LA Homes may request clarification or professional assessment before proceeding.

We will not knowingly undertake work that breaches applicable safety requirements.

26. INSURANCE

LA Homes will maintain insurance appropriate to its operations and legal obligations.

The nature and extent of insurance cover may vary according to the service being provided.

Where requested and applicable, customers may ask for information about relevant insurance arrangements.

Customers are responsible for maintaining appropriate insurance for their property and belongings.

For major construction projects, responsibility for works insurance, existing structures insurance and other project-specific cover should be expressly agreed before work begins.

27. DAMAGE TO PROPERTY

LA Homes will take reasonable care to protect customer property during the provision of services.

Where damage is caused by our negligence, breach of contract or other legally actionable conduct, responsibility will be determined in accordance with applicable law.

Customers should notify us promptly of any damage they believe occurred during the works.

LA Homes may request reasonable access to inspect the alleged damage.

Nothing in these Terms and Conditions excludes or restricts liability where doing so would be unlawful.

28. LIMITATION OF LIABILITY

LA Homes will be responsible for losses caused by our breach of contract or negligence to the extent required by applicable law.

We do not exclude or limit liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Breach of statutory obligations where liability cannot lawfully be excluded

  • Any other matter for which exclusion or limitation is prohibited by law

For business-to-business contracts, any agreed limitation of liability must be expressly stated in the relevant contract and will apply only to the extent permitted by law.

Nothing in these Terms and Conditions removes or restricts the statutory rights of consumers.

29. WEBSITE USE

Customers may use lahomes.store to obtain information, request quotations, make enquiries and access available services.

Users must not:

  • Use the website for unlawful purposes

  • Attempt to gain unauthorised access to website systems

  • Introduce viruses or malicious software

  • Interfere with website functionality

  • Submit fraudulent enquiries or bookings

  • Misuse website content or intellectual property

LA Homes may restrict access where reasonably necessary to protect the website, its users or business operations.

However, website content may contain occasional errors or outdated information.

The final agreed scope, specification and price will be established through the relevant booking confirmation, quotation or contract.

31. INTELLECTUAL PROPERTY

Website content, branding, logos, photographs, graphics and written materials belonging to LA Homes are protected by applicable intellectual property laws.

Customers and website visitors must not reproduce, distribute or commercially exploit protected materials without appropriate permission.

Where project drawings, designs or other professional documents are supplied, ownership and permitted use will be governed by the relevant agreement.

32. DATA PROTECTION AND PRIVACY

LA Homes respects customer privacy and is committed to handling personal information in accordance with applicable data protection legislation.

This includes the UK General Data Protection Regulation and the Data Protection Act 2018.

We may collect and process information necessary to:

  • Respond to enquiries

  • Prepare quotations

  • Manage bookings

  • Deliver services

  • Process payments

  • Communicate with customers

  • Maintain business records

  • Comply with legal obligations

Further information is provided in our Privacy Policy.

Customers may contact info@lahomes.store with questions about how their personal information is handled.

33. COOKIES AND WEBSITE TECHNOLOGY

Our website may use cookies and similar technologies to support functionality, improve user experience and understand website performance.

Where legally required, we will obtain consent before placing non-essential cookies.

Further information about cookies and related choices should be provided through our website's cookie information and consent controls.

34. CUSTOMER REVIEWS AND FEEDBACK

LA Homes welcomes genuine customer feedback.

Customers may submit reviews, testimonials or comments about their experience.

We will not knowingly publish misleading or fabricated customer reviews.

Any use of personal information in customer testimonials will comply with applicable data protection requirements.

35. PHOTOGRAPHS AND PROJECT PORTFOLIOS

Photographs taken for internal contractual purposes will be handled appropriately.

We will obtain any necessary permission before using identifiable private property images, personal information or other protected content in public marketing materials.

Customers may contact us to discuss the use of project photographs.

36. COMPLAINTS PROCEDURE

Customer satisfaction is important to LA Homes.

If you are dissatisfied with any aspect of our services, please contact us using the details below.

  • The property or project concerned

  • A description of the issue

  • Your preferred resolution

We will acknowledge and investigate complaints within a reasonable timeframe.

Where appropriate, we may arrange a site inspection or request additional information.

We aim to resolve disputes fairly and professionally.

37. DISPUTE RESOLUTION

Where a disagreement arises, both parties should first attempt to resolve the matter through direct communication.

If an agreement cannot be reached, the parties may consider mediation or another appropriate dispute resolution process.

For qualifying construction contracts, statutory adjudication rights may apply under the Housing Grants, Construction and Regeneration Act 1996, as amended.

The availability of statutory adjudication depends on the nature of the contract and any applicable exclusions, including those concerning certain residential occupiers.

Nothing in this section prevents consumers from exercising their statutory rights or pursuing remedies through the courts.

38. EVENTS OUTSIDE OUR REASONABLE CONTROL

LA Homes will not be responsible for a failure or delay caused by circumstances outside our reasonable control to the extent permitted by applicable law.

Such circumstances may include:

  • Severe weather

  • Natural disasters

  • Major utility failures

  • Government restrictions

  • Industrial disruption

  • Significant supply chain interruptions

  • Other exceptional events beyond reasonable control

Where such circumstances arise, we will notify affected customers and discuss reasonable arrangements for continuing, rescheduling or cancelling the services.

Customers will retain any applicable statutory rights.

39. TERMINATION OF SERVICES

Either party may be entitled to terminate a service agreement in circumstances specified by the contract or applicable law.

LA Homes may have grounds to terminate where:

  • A customer commits a serious contractual breach

  • Agreed payments remain unpaid following any required notice

  • Unsafe conditions prevent lawful performance

  • The customer engages in threatening or abusive behaviour

  • Continued performance becomes unlawful or impossible

Any termination will be handled in accordance with applicable contractual and statutory requirements.

Where termination occurs, payment obligations and any refunds will be assessed according to work completed, costs reasonably incurred, the contract and applicable law.

40. THIRD-PARTY SERVICES

Certain projects may involve independent professionals, suppliers or service providers.

These may include architects, structural engineers, surveyors, planning consultants and specialist contractors.

Where a customer enters into a separate contract directly with a third party, that contract will govern the third party's obligations.

Where LA Homes engages a third party as our subcontractor, our responsibilities to the customer will remain subject to the applicable contract and law.

41. COMMUNICATIONS

LA Homes may communicate with customers through telephone, email, website forms, text messages or other agreed channels.

Customers should ensure their contact details remain accurate.

Important contractual changes, variations and approvals should be confirmed in writing.

Electronic communications may form part of the contractual record where legally valid.

42. CHANGES TO THESE TERMS AND CONDITIONS

LA Homes may update these Terms and Conditions to reflect changes in legislation, business operations, services or website functionality.

Updated terms will be published on our website with a revised date.

Changes will not automatically alter existing contracts unless the contract permits the change and applicable law allows it.

Where customer agreement or advance notice is legally required, we will comply with those requirements.

43. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply where legally possible.

Any invalid provision will be interpreted or disregarded only to the extent required by law.

44. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of England and Wales.

Disputes will be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer protection law gives a customer the right to bring proceedings in another jurisdiction.

Nothing in this section restricts mandatory consumer rights.
